JUDGMENT / ORDER

Petitioner seeks quash of proceedings in S.T.C.No. 324 of 2012 on the file of learned Judicial Magistrate,Fast Track Court II, Erode.
2. Heard learned counsel for petitioner and learned counsel for respondent.
3. Petitioner, who is the second accused in case pending trial in S.T.C.No. 324 of 2012, has been arrayed as accused on the allegation that he is the Manager of the concern of the first accused. Admitted position where the first accused is the proprietor of the concern and it is the first accused, who has, in such capacity, issued the cheque, the prosecution of this petitioner/ second accused totally is unfounded.
4. The Criminal Original Petition is allowed. The proceedings in S.T.C.No. 324 of 2012 on the file of learned Judicial Magistrate, Fast Track Court II, Erode, is quashed insofar as this petitioner is concerned. Connected Miscellaneous Petition is closed.
5. Considering that the case is of the year 2012, this Court direct the Court below to dispose of S.T.C.No. 324 of 2012 within a period of five months from the date of receipt of this order. 06.04.2017 Index:yes/no Internet:yes bri/gm C.T.SELVAM, J bri/gm To The Judicial Magistrate, Fast Track Court No.II, Erode.
