D.Joesph Nelson vs The District Collector

Madras High Court|25 July, 2017

JUDGMENT / ORDER

[Order of the Court was made by PUSHPA SATHYANARAYANA] This writ petition has been filed for Mandamus, forbearing the second respondent from proceeding with the construction of Sewerage junction on the Public road and sewerage collection well pumping station with generator in the midst of residential houses in Pandrimalai Swamigal Street, Dindigul.
2. It appears from the records that during the pendency of this Writ Petition, the very same petitioner through another counsel had filed a Writ Petition No.1422 of 2017, in which the petitioner had sought for a direction to the respondents not to construct the drainage collection pumping station over the Government Promboke land in T.S.No.155-56, as the drinking water pipelines are already laid there. For the reasons best known, the petitioner had not pressed the said writ petition.
3.It is submitted by the learned Special Government Pleader that already sewerage pumping station is shifted to the neighbouring land and the prayer sought for by the petitioner is satisfied. Hence, nothing survives in this writ petition and the same is, accordingly, dismissed. No costs. Consequently, connected miscellaneous petitions are also dismissed.
To
1.The District Collector, Dindigul District.
2.The Commissioner, Dindigul Corporation, Dindigul.
3.The Tahsildar, Taluk Office (East), Dindigul.
