This Criminal Petition is filed to set aside order dated 15/09/2011 passed in FCOP.No. 1304 of 2009 on the file of Judge, Family Court, Visakhapatnam.
2. This Court permitted the petitioner to take out personal notice to the first respondent by registered post with acknowledgement due and directed to file proof of service and posted the matter to 29/03/2012. On 29/03/2012 Advocate for petitioner took time for filing proof of service and it is adjourned to 12/04/2012. On 12/04/2012 again time is extended for filing proof of service on therequest of Advocate for petitioner till 11/06/2012, thereafter the matter is not listed and when it is listed on 16/04/2014 no one appeared for the petitioner till 02:55 p.m., the matter is adjourned to this day under the caption of dismissal.
3. Today also no one appeared for the petitioner inspite of posting the matter under the caption of dismissal and proof of service is not filed complying the order of this court. Therefore, this Criminal Petition is dismissed for non-compliance of the order.
