Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondent.
The petitioner is before this Court with request to command the respondent authorities to consider and decide the representation of the petitioner dated 18.07.2019 followed by a reminder dated 14.09.2019, copies whereof are contained in Annexure-I to the writ petition and pay the petitioner the admissible pay scale of the post of constable from the date of his appointment i.e. 09.08.1982 till 02.06.1993 as well as the pay scale admissible to the post of Head Constable from 03.06.1993 to the petitioner.
Learned counsel for the petitioner states that in similar circumstances, the ACP benefit, after completion of 26 years of satisfactory service, has been extended to other incumbents and they have been accorded pay scale of Rs.60,400/- on 01.07.2019 (after providing two increments). The details of which is appended on page 22 of the writ petition. Even though, the Finance Controller of the Government of U.P. in November 2018 has fixed the pay of petitioner to the tune of Rs.56,900/-, the said benefit has not been extended to the petitioner.
Learned Standing Counsel fairly states that in case any appropriate representation/application is moved by the petitioner before the competent authority, the same will be considered and decided expeditiously.
With the consent of the parties and without expressing any opinion on the merits of the issue, the present writ petition stands disposed of finally with a direction to the second respondent to look into the grievance of the petitioner and for the said purpose in case any application/representation is moved by the petitioner within a week's time from today, definitely, the same would be looked into, examined and remedied within two months further time from the date of production before him.
