… Respondents (By Sri. T.P. Muthanna, Advocate) This Writ Petition is filed under Articles 226 and 227 of the Constitution of India, praying to direct the respondents to consider the request of the petitioner and grant 60 days time to deposit the auction amount and etc.
This Writ Petition coming on for Preliminary Hearing in ‘B’ Group this day, the Court made the following:-
ORDER Sri. Prabhugouda U.B., learned counsel for Sri. H.M. Siddhartha, learned counsel for the petitioner.
Sri. T. P. Muthanna, learned counsel for the respondents.
The petition is admitted for hearing. With the consent of learned counsel for the parties, the same is heard finally.
2. In this petition, the petitioner inter alia seeks for a writ of mandamus directing respondent No.1 to consider the request of the petitioner and to grant sixty days time to deposit the auction amount.
3. When the matter was taken up today, learned counsel for the respondents has rightly pointed out that the writ petition has been rendered infructuous on account of efflux of time as the period of sixty days has been expired on 02.07.2019.
4. In view of the aforesaid submission, writ petition is disposed of with liberty to the petitioner to take recourse to such remedy as may be available to her under the law.
With the aforesaid liberty, the petition is disposed of.
