(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) Not only that the impugned order of learned Single Judge is expressly made under Article 227 of the Constitution but admittedly original petition preferred by the appellant was challenging the award of the labour Court and the petition was preferred therefrom after delay of about nine years. Under the circumstances, the appeal is found to be not only devoid of merits but not maintainable. Accordingly, it is dismissed along with Civil Application.
