Rule returnable on 05.09.2012. Mr. Paritosh Calla, learned advocate for the respondent no. 2 waives service of notice of Rule.
Interim relief in terms of para 8(C ) is granted on the following conditions:
The respondent workman shall be paid his retirement dues as if the order of the Tribunal is not stayed within a period of eight weeks from today.
The amount of backwages as per the order of the Tribunal shall be deposited before this Court within a period of eight weeks from today.
The amount so deposited shall be invested with a Nationalized Bank by way of a Fixed Deposit initially for a period of three years and on maturity, shall be renewed by one year at a time till final disposal of the this petition.
The said FD Receipt be retained by the Nazir of this Court.
Interest accrued thereon shall not be paid to either parties but shall continue to accrue and be added on to the deposit on maturity/renewal.
The aforesaid order is subject to the rights and contentions of the parties.
Any breach of any of the conditions mentioned hereinabove shall automatically vacate the relief without the matter being referred to this Court.
