Heard Mr.Nikunt K. Raval, learned advocate for the petitioner. It is submitted by him that the impugned award of the Tribunal dated 12.10.2011, appointing respondent No.1, as a Clerk amounts to a review of the earlier award dated 07.06.1990 passed in Reference (LCV) No.330/1992, whereby he was directed to be reinstated as a Conductor. It is submitted that no powers of review are available to the Industrial Tribunal and, in any case, not in a fresh Reference.
Issue Notice returnable on 27.06.2012.
The implementation, operation and execution of the impugned award dated 12.10.2011 passed by the Presiding Office, Industrial Tribunal No.2, Vadodara in Reference (IT) No.54/2007, shall remain stayed till then.
