1. This Court (Coram : K.S. Jhaveri, J.) by order dated 20.3.2012 was pleased to admit the matter and grant stay against backwages on condition that the retiral benefits of respondent No.1 workman will be paid to the workman before the returnable date i.e. 18.4.2012.
2. Thereafter, the matter was adjourned at the request of Mr. M.I. Merchant, learned Counsel for respondent No.1 - Workman and on 23.4.2012 the learned Counsel for the petitioner was not present because of illness.
3. Today, Mr. Raval, learned Counsel appearing for the petitioner tenders photocopies of the two cheques as well as vouchers of payment towards gratuity and the receipt thereof. Mr. Merchant on instructions from respondent No.1 - workman who is present in the Court as identified by Mr. Siddharth Varmora, learned Counsel appearing with Mr. Merchant for respondent No.1 - workman, does not dispute the same.
4. Considering the above aspect ad-interim relief granted by order dated 20.3.2012 is confirmed as interim relief and the same shall continue till final hearing of this petition.
