THIS WRIT PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER R. DEVDAS J., (ORAL):
Learned counsels for the petitioner and respondents have filed a Joint Memo dated 20.03.2019, stating that the parties to the proceedings have agreed to settle the matter and seek modification of the award dated 30.10.2015, in I.D.Reference No.7/2013, passed by the Labour Court, Chikkamagaluru, in the following terms:
“The Petitioner Corporation to provide an appointment on compassionate grounds to one of the legal representatives of the deceased respondent who posses the requisite qualification, subject to fulfillment of rules and regulations relating to appointment on compassionate grounds prevailing in the Corporation, in lieu of all the other benefits granted by the Labour Court in the award impugned.”
2. The respondents have agreed to forgo the entire backwages and other financial benefits as awarded by the Labour Court in view of the settlement arrived between the parties.
3. The Joint Memo is taken on record.
4. The award dated 30.10.2015, in I. D. Reference No.7/2013, passed by the Labour Court, Chikkamagaluru is modified in terms of the settlement arrived at between the parties. The writ petition is accordingly disposed of.
