Divisional Controller vs Bhikhabhai Ramabhai Vasava

Heard learned advocate for the petitioner. The respondent raised industrial dispute after a delay of 9 years and during the pendency of the reference the respondent reached the age of superannuation on 31.05.2006. The Labour Court held that the inquiry was not just and legal and the same was quashed and set aside. There are as many as 38 defaults committed by the respondent. In spite of this no penalty is imposed upon the respondent. Hence by way of interim relief the judgement and award of the Labour Court is stayed.
