JUDGMENT / ORDER

The petitioner is the registered owner of a stage carriage bearing registration No.KL-02-M-4444, which the petitioner is operating with temporary permit on the route Varkala-Asramam Nair's Hospital in the vacancy of stage carriage KL-02-W-711. The present permit expired on 18.5.2014. The petitioner has submitted Exhibit P2 application before the respondent for re-issuance of temporary permit. The grievance of the petitioner is that Exhibit P2 application is still pending consideration before the respondent. Therefore, the petitioner seeks an order from this Court directing the respondent to consider and pass appropriate orders on Exhibit P2 application within a time frame, that may be fixed by this Court. 2. Heard the learned counsel for the petitioner and the learned Government Pleader appearing for the respondents.
3. In the facts and circumstances of the case, this Writ Petition is disposed of as follows:
If the vacancy of stage carriage bearing registration No.KL-02-
W.P.(C).No.12722/14 -2-
W-711 is still in existence and any other person has not applied for temporary permit to operate stage carriage in that vacancy, there shall be a direction to the respondent to issue temporary permit of four months' duration to the petitioner within three weeks from the date of production of a certified copy of this judgment by passing appropriate orders on Exhibit P2. Needles to say that, such re-issuance of temporary permit will be subject to the preferential claim of other persons, if any.
