Learned Advocate for the petitioner Mr. M.A. Kharadi states that inspite of the specific contentions raised in the petition about not following the procedure under Section 5 of the APMC Act, a reply filed by the Under Secretary (Credit), Agriculture and Co-operation Department, Sachivalaya, Gandhinagar, State of Gujarat do not mention about issuance of notification in the official gazette by the Director about declaring his intention of regulating the purchase and sale of such agricultural produce in an area as may be specified therein.
In view of the above, power to de-notify or divide the market area as envisaged under Section 52 of the Act is illegal as of bifurcating of APMC, Santrampur-Kadana and APMC, Fatehpura.
At this juncture, learned Assistant Government Pleader seeks time.
The matter be listed on 26th July, 2012.
