JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA)
1. The application is made for condoning delay of 1549 days in preferring the appeal. The only ground mentioned in the application for condonation of delay is that the applicant was collecting information from the respondents and thereafter he was eager to challenge the order. However, since the applicant was Class-IV employee and working as Peon, he was not having fund for engaging an advocate. It is further stated that the applicant has now managed the funds from his friends and relatives, and thereafter, contacted the advocate and thereafter immediately preferred the appeal.
2. Not only that the ground sought to be made out in the application is absolutely vague and without any supporting material, but the delay is so inordinate that it cannot lightly be excused. There is no denying the fact that the applicant has appeared before learned Single Judge through learned advocate and it is difficult to believe that he could not have availed of the legal aid and assistance provided under various schemes and it would have taken nearly three years for him to save and collect funds to file present application. Therefore, the cause sought to be canvassed being neither sufficient nor satisfactory, the application is summarily dismissed.
