This appeal has been filed questioning the impugned award on the ground of quantum.
2.The claimant had suffered injuries in an accident involving the vehicle belonging to the appellant department. The Tribunal rightly fixed the negligence on the driver of the Government vehicle. However, while awarding the compensation a sum of Rs.30,000/- has been awarded towards temporary loss of income. This is not correct. The compensation is reduced by sum of Rs.30,000/-. The claimant is entitled to Rs.1,90,443/-.
3.Accordingly, the award dated 23.08.2013 in M.C.O.P.No.140/2011 on the file of the Motor Accident Claims Tribunal/Principal District Judge, Pudukkottai is modified.
4.The appellants are liable to pay the said sum of Rs.1,90,443/- with interest at 7.5% per annum and cost from the date of petition till the date of realization within a period of twelve weeks from the date of receipt of a copy of this order, less the amount already deposited, if any. On such deposit the claimant is entitled to withdraw the entire amount, less the amount already withdrawn by him, if any, by filing proper application before the Tribunal.
5. This Civil Miscellaneous Appeal is partly allowed. No costs. Consequently, connected miscellaneous petitions are closed.
