ORDER:
This Writ Petition was filed challenging the action of the first respondent in making attempts to dispossess the petitioner from the land to an extent of Ac.5.00 cents in Sy.No.115/3 of A.Narayanapuram village, Ananthapur Mandal and District without issuing notice to him.
The first respondent filed counter affidavit stating that the petitioner was dispossessed from the land only after observing that the land assigned to him was never cultivated by him and it was resumed to the Government on 20.07.2007. After resuming the land, the second respondent issued house site pattas to the eligible beneficiaries and the land was handed over to the first respondent for construction of houses to the beneficiaries. The Corporation has taken up for construction of 130 houses with a proper layout and they are at different stages.
In view of the above submission of the first respondent in the counter affidavit, nothing survives for adjudication in the present Writ Petition.
The Writ petition is dismissed accordingly. However, right of the petitioner to challenge the resumption of the land to the Government on 20.07.2007 is left open to him.
As a sequel to the disposal of the Writ Petition, miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed.
