Mr. K.G. Pandit, learned Advocate for the petitioners candidly submits that during the pendency of this petition since 1989 till date, some of the respondents have died and petitioner no.1 also has expired and therefore, the petitioners have filed Civil Application No. 1549 of 2012. Mr. Pandit submits that instead of further amending the petition to bring on record the heirs of respondents no. 5, 6 and 7 who have expired, the learned Advocate for the petitioners seeks permission to withdraw the same with a liberty to file afresh with proper title on the same subject matter i.e. challenging the very impugned order which is challenged in this petition. Permission granted. The petition stands disposed of as withdrawn with a liberty to file a fresh petition with proper parties on the same subject matter. Rule discharged with no order as to costs. Status quo stands vacated. CIVIL APPLICATION No. 1549 of 2012
In view of the order passed in main matter, this Civil Application does not survive. The petitioner is at liberty to bring on record the proper parties on the same subject matter in the petition. The Civil Application stands disposed of accordingly.
