The petitioner herein claims that the online complaint dated 28.12.2020 against the respondent no. 5 had not been lodged by him rather some unknown person had lodged the said complaint in the name of the petitioner. Submission is that the petitioner had given application before the Superintendent of Police, Sonbhadra to assail the said fact. However, the S.H.O. concerned is not understanding the stand of the petitioner.
The prayer in the writ petition is as follows:-
"(A) Issue a writ, order or direction in the nature of mandamus commanding the respondents not to harass the petitioner without following the procedure of law."
Noticing the above submission, we provide that the petitioner shall approach the Superintendent of Police, Sonbhadra along with his affidavit giving his stand with regard to the complaint filed in his name.
In case such an affidavit is filed, the Superintendent of Police, Sonbhadra shall do the needful in accordance with law.
The writ petition is, accordingly, disposed of.
