On the basis of instructions learned Standing Counsel submits that the marks of the petitioners have been increased upon fresh consideration of the controversy. The latest position of marks scored is as follows; Petitioner no. 1 Dipanshu has scored 37 marks in the subject of Social Studies, Petitioner no. 2 Umesh Chandra Dubey has scored 20 marks in the subject of Hindi and Petitioner no. 3 Fateh Bahadur Yadav has scored 44 marks in the subject of Social Studies. All the petitioners are declared passed.
Sri O.N. Mishra, learned counsel for the petitioner submits that the cause of action on which the petition was filed does not survive but he recasts his relief. He submits that the correct mark sheet of the petitioner may be provided within a stipulated period of time.
The respondent no. 2, Secretary, Examination Regulatory Authority, U.P. Allenganj, Allahabad is directed to provide corrected mark sheet incorporating the said increase in marks, to the petitioner through proper channel and as per the prescribed procedure within a period of ten days from the date of receipt of a certified copy of this order.
The writ petition is disposed of.
