Heard Mr. K.G.Vakharia, learned Senior Advocate for petitioner and learned APP for the respondent - State.
With regard to prayer and subject matter of the petition, on 14.02.2012, the following order was passed:
"Heard Mr. K.G.Vakharia, learned Senior Advocate appearing with Mr. M.J.Parikh, learned advocate for the petitioner and learned APP for the respondent - State of Gujarat.
2. In addition to what is recorded in earlier order dated 20.01.2012, it is to be noted that the subject matter of the petition for which civil proceedings are undertaken and terminated before this Court in the form of Appeal From Order No.236 of 2010 and contempt application filed therein came to be withdrawn by respondent No.5 herein.
3. In view of the above factual aspect, no further harassment be meted out to the petitioner in any manner whatsoever by respondent - Investigating Officer.
4. Learned APP states that there is no harassment caused to the petitioner by any one.
Post the matter on 26th March, 2012.
Interim relief granted earlier to continue till final disposal of the petition".
Mr.
J.K.Shah, learned APP, on instructions, states that the applicant will not be subjected to undue harassment with regard to subject matter of this petition since civil proceedings are pending between the parties.
In view of the above, at this stage, the grievance of the petitioner does not survive any more. This petition is disposed of in view of what is recorded in order dated 04.02.2012 and the statement of learned APP, as above. However, the petitioner is at liberty to approach the appropriate forum, in case of any difficulty.
Notice is discharged. However, there shall be no order as to costs.
