Vide order dated 22.02.2006 passed in Criminal Miscellaneous Application No.98/2006 the learned Sessions Judge, Panchmahal-Godhra granted bail to the applicant by imposing suitable conditions.
Heard learned Advocate for the applicant, who submits that the applicant is a businessman who intends to travel to Indonesia for three months. The applicant is residing with his family members at Baroda and also has an immovable property there. The case is also pending before the Trial Court and it will take some time for disposal of the case.
Considering this aspect, it prayed that the Trial Court be directed to release the passport of the applicant, which was surrendered as per the conditions of bail and this Court may also quash and set aside the order of the learned 7th Additional Sessions Judge, Panchmahal, Godhra whereby the application was rejected. It is also submitted by the learned Advocate for the applicant that only after obtaining permission from the concerned Trial Court, the applicant will travel abroad.
Considering the submissions of the learned Advocate for the applicant and considering the fact that in pursuance of the order of bail passed as early as on 22.02.2006, no untoward incident has happened and the applicant has been complying scrupulously with all the conditions, I deem it just and proper to suspend the condition No.6 imposed by the the Sessions Court in Criminal Miscellaneous Application No.98/2006 for a period of three months, from today. I also deem it just and proper to quash and set aside the order dated 14.07.2011 passed by the learned Sessions Judge, Godhra in Criminal Miscellaneous Application No.507/2011.
It is made clear that on his return from abroad, the applicant will surrender his passport immediately before the concerned Trial Court.
Rule made absolute to the aforesaid extent. Direct Service is permitted.
