This application under Section 482 of Cr.P.C. has been filed by the applicants with the prayer to quash the impugned order dated 24.10.2017 passed by learned A.C.J.M., Court No. 7, Aligarh in Case No. 235 of 2017, Smt. Dimple vs. Dipak and others, under Sections 12, 18, 20, 22 of Domestic Violence Act, P.S.- Bannadevi, District- Aligarh whereby learned court below has instituted ex-parte proceedings against the applicants as well as the entire proceedings in the aforementioned case.
Heard learned counsel for the applicants and learned A.G.A. for the State. Perused the record.
Learned counsel for the applicants has not been able to point out any such illegality or impropriety, much less than any abuse of court's process which may persuade this Court to interfere in either the impugned order or the proceedings. Negligence of the applicants is apparent on the face of record and it was because of that reason, the court was constrained to proceed ex-parte in the matter, which it did.
The application lacks merit and stands dismissed.
