The petitioner applied for a temporary permit to conduct service on the route Kannur - Chempathotty in respect of stage carriage bearing No.KL-14 C 8938 in the vacant timings of stage carriage bearing No.KL-59 B 8228, Ext.P1. The petitioner prays for issuance of temporary permit to his stage carriage No.KL-14 C 8938 on the aforesaid route in the vacant timings of stage carriage bearing No.KL-59 B 8228. 2. If vacancy of stage carriage bearing registration No.KL-59 B 8228, is still in existence and no other person has applied for a temporary permit to operate a stage carriage in that vacancy, there shall be a direction to the respondent to issue a temporary permit of four months duration within one week from the date of WP(C).31198/14 2 production of a copy of this judgment by passing appropriate orders on Ext.P1. Needless to say, such issuance of temporary permit will be subject to the preferential claim, if any.
