JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL)
1. It has been stated by the learned APP that Legal Department has not received the proposal or otherwise from the concerned Public Prosecutor of Sessions Case No. 66/2010.
2. We are surprised by the approach of the Legal Department of the State that when it is known to the State that the appeal has been preferred by the private party/original complainant, it would be expected for the State to report to this Court about the action or inaction or having accepted the judgment of the learned Sessions Judge. If the proposal is not received, nothing prevents the Legal Department or the Secretary, Legal Department of the State Government, to call for the response and the opinion of the concerned Public Prosecutor. Hence, as a last opportunity, time is granted till 12.3.2012. If the response is not received by that date, appropriate orders will be passed to direct the Secretary, Legal Department, to remain personally present.
