Dineshchandra vs Virchand

High Court Of Gujarat|21 June, 2012

JUDGMENT / ORDER

1. The petitioner or respondent no.4 shall place on record copy of Rojkam and also chronology of the dates of adjournments in the respective orders passed on each date. So as to enable the parties to place on record the said details, proceedings are adjourned to 28/06/2012.
2. Under the order dated 15/06/2012, it is already clarified that the matter will be taken up for final decision on the returnable date. Therefore, parties shall address the Court on next date for final decision of the matter.
3. Learned advocate Mr.Pandya appearing for respondent nos.1 to 3 has submitted that the said respondents are ready to proceed with the hearing of the matter on any date convenient to the Commissioner and would not request the Commissioner for adjournment.
4. The limited objection which is raised by the petitioners in present petition is against the order of injunction inasmuch as instead of restricting the injunction order to the next date of hearing. The authority has passed injunction order which is "until further orders" and the next date of hearing is in August, 2012. Since Mr.Pandya learned advocate has submitted that the respondents are ready to proceed with the hearing before the next date fixed by the Authority-even in the next week-however, the authority will have the next sitting at Rajkot only on 07/07/2012. He also submitted that the respondent are ready to appear before the authority at Ahmedabad also. On the said aspect, learned advocate for the parties shall ascertain the date convenient to the Commissioner for hearing.
5. The cause list shows that process has remained unserved qua respondent nos.1 to 3 because of refusal. However, learned advocate Mr.Patel has appeared today and submitted that he has received instruction to appear for respondent nos1 to 3 and he has also entered appearance/Vakalatnama today. In the reply to be filed by the said respondents, the respondents shall explain the refusal of process of the Court. S. O. to 28/06/2012.
