Mr.
Kavina, learned Senior Counsel urges this Court for withdrawal of present petition and such permission is granted in wake of pendency of Regular Civil Appeal No. 22/11 before the Additional District Judge, Dhrangadhra, Dist Surandranagar. Challenge in the appeal is to the order passed under Order-7 Rule 11(D) of the Code of Civil Procedure rejecting the suit of the present petitioner. Considering the urgency and the challenges, made therein he seeks withdrawal seeking direction for expeditious hearing of appeal by the learned District Judge.
Petitioner may make such request before learned District Judge and merit of such request on considering the challenges, would be decided by the court concerned.
Petition stands disposed of in terms above.
