JUDGMENT / ORDER

In the first session, when the petition was called out and taken up for hearing, Mr. Marshall, learned Senior Advocate, with Mr. Kapadia, learned advocate for the petitioners, were present. However, Mr. Pandya, learned advocate for the respondent No.3, was not present. On behalf of learned advocate for the respondent No.2, request for pass over was made.
The request made on behalf of the respondent No.2 was granted.
Since learned advocate for the respondent No.3 was not present, the hearing was deferred to second session.
Now, in the second session also, learned advocate for the respondent No.3 is not present.
Under order dated 28.2.2011, office was directed to issue notice, making it returnable on 14.3.2011. Since then, ad-interim relief, granted by the Court is in operation, however, the proceedings have been adjourned from time to time. Almost 18 months have passed since the petition is rotated on admission board and ad-interim relief is being extended.
As a last chance to the concerned respondents, the hearing is adjourned so as to enable the learned advocate for the concerned respondents to remain present at the time of hearing and making submissions.
On the next date, the Court may be constrained to pass appropriate order in absence of learned advocate for the respondent, if any reasonable cause for absence is not brought to the notice of the Court.
