Heard counsel for the applicant as well as learned AGA and perused the record.
The present application under section 482 Cr.P.C. has been filed challenging the order dated 30.3.2019 by which the court below has issued the process under section 82 Cr.P.C. in case Crime No. 07 of 2019 (State Vs. Arvind Singh), under sections 376, 511 IPC and section 3/4 POCSO Act and section 3(2)(V) SC/ST Act, Police Station Kothibhar, District Maharajganj, pending in the court of learned Addl. Sessions Judge, Court No. 1, Maharajganj.
Considering the facts that since the process of section 82 Cr.P.C. is in operation and applicant desires to surrender before the court below and undertakes protection of 15 days, it is directed that the operation and effect of the order dated 30.3.2019 shall be kept in abeyance for a period of 15 days from today and during this period applicant would surrender and get himself bailed out.
With the aforesaid observations, this application is finally disposed of.
