Heard Sri Ashok Kumar Maurya, learned counsel for the petitioner, learned AGA for the respondents-State and perused the record.
The grievance of the petitioner is with regard to fair investigation in Case Crime No. 0015 of 2018 pending investigation at Police Station - Sahatwar, District- Ballia and also to lodged an first information report as per the assertions made in the application dated 15.02.2018 and further reiterated on 07.03.2018.
It is submitted by learned counsel for the petitioner that the elder brother of the petitioner Sri Rameshwar Gond has submitted a detailed representation to Superintendent of Police, Ballia pertaining to the same issue and the Superintendent of Police, Ballia has yet not taken any positive step on the representation.
Having considered all facts of the case, we deem it appropriate to dispose of this petition for writ by directing the Superintendent of Police, Ballia to consider the grievance of elder brother of the petitioner Sri Rameshwar Gond ventilated under the representation dated 07.03.2018 of the petitioner, stated in the petition for writ. For the purpose, the petitioner is required to present a memo of this petition for writ along with certified copy of this order before the Superintendent of Police, Ballia within a period of 15 days from today. If the petitioner presents a memo of writ petition and a certified copy of this order, the Superintendent of Police shall act upon expeditiously as soon as possible within a period of two months subsequently thereto.
