Heard Sri Satendra Singh, learned counsel for the petitioner and Sri B.N. Singh, learned counsel appearing for the Union Bank of India.
The petitioner is a Black Smith. He is challenging recovery certificate dated 28.10.2017 for a sum of Rs. 2,00,067/- plus others. The aforesaid recovery is in respect of a loan amount taken by the petitioner for smith work.
Learned counsel for the petitioner accepts the liability to pay the said amount and submits that he is ready and willing to pay the same provided some reasonable time is allowed and installments are fixed.
Learned counsel for the Union Bank of India also wants that the amount be cleared at the earliest.
In view of the aforesaid facts and circumstances, we dispose of the writ petition in the ends of justice, with the direction to the petitioner to pay a sum of Rs. 50,067/- within a period of one month or latest by 31st October 2019 and the balance amount of Rs. 1.5 lakhs in six equal installments of Rs. 25,000/- each payable in the months of November, December, 2019, January, February, March and April, 2020 respectively.
The last installment will include all interest that may accrue on the aforesaid outstanding amount.
In the event of default in payment of any of the installments, the benefit of this order would automatically come to an end.
