This application u/s 482 Cr.P.C. has been filed seeking direction to the court below to consider and decide the bail application of the applicant on the same day in criminal complaint no. 1964 of 2017 under Section 365 IPC, P.S. Badagaon, District Jhansi.
Heard learned counsel for the applicants and the learned AGA appearing for the State.
It appears that the applicants had earlier approached this Court through application u/s 482 no. 12871 of 2019 for quashing the entire proceedings of the aforesaid complaint case which was dismissed vide order dated 9.4.2019. Present application has been filed seeking direction to the Court below to consider and decide the bail application on the same day.
Having regard to the facts and circumstances of the case and having considered the submissions made by the learned counsel for the parties, directions as prayed for cannot be given to the Court below. Applicants are at liberty to appear before the Court below and apply for bail and the Court concerned is enough competent to pass suitable order. Hence, the prayer made in the application is refused. Application is liable to be dismissed and the same is accordingly dismissed.
