During the course of hearing learned advocate Shri Mehul S. Shah appearing for the petitioner seeks to withdraw this petition on the ground that the petitioner is desirous of preferring an application for amendment of the plaint and subsequent thereto, if permissible under the law, petitioner wishes to make an appropriate application afresh before the trial court.
Permission is granted qualifying the same by stating that permitting withdrawal would not amount to this court endorsing to the reasons proposed for the withdrawal. If permissible under the law, recourse may be made to the same.
Petition stands disposed of as withdrawn in the terms above.
