Challenge is made to the order passed by the trial court permitting the present petitioner-original plaintiff to withdraw the suit as per purshis Exh. 89 by Regular Civil Suit No. 23/2006 under Order 23 Rule 1(1) and Rule 1(3) of the Code of Civil Procedure.
During the Course of hearing learned advocate Mr Mehta seeks to withdraw this petition on having noted that interms of purshis Exh. 89 the Court has permitted the withdrawal and, Revision Application against such withdrawal is pending before the trial court of the respondent herein.
Withdrawal of the present petition is permitted with a liberty to approach this Court in the event of any difficulty within 8 weeks of this order.
This petition stands disposed of interms of withdrawal.
