Heard learned counsel for the applicant.
This contempt application has been filed alleging that the opposite party, i.e. the District Magistrate, Jaunpur has deliberately flouted the order dated 28.02.2018 passed in Writ-C No.8005 of 2018 (Dinesh Rai vs. State of U.P. and 3 others). Perusal of the order of the Writ Court shows that direction to the District Magistrate has been given for deciding the representation of the applicant within a period of two months from the date of receipt of the representation and production of a certified copy of the order. The aforesaid order of the writ court is dated 28.02.2018. The period provided to the District Magistrate has not expired. The dispute of land is between the applicant and the concerned Nagar Panchayat. Thus, no case for contempt has been made out against the opposite party.
Consequently, the contempt application is dismissed at this stage.
