Nasrulla Khan, HCGP) … Petitioners … Respondent This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure 1974 praying to quash the complaint initiated by SUO MOTO and filing FIR vide Crime No.0213/2015 dated 11/07/2015 by the Belur Police Station, pending before the Addl. Civil Judge (Sr.Dn) and JMFC, Belur, Hassan District.
This petition coming on for admission, this day, the Court made the following:
ORDER Heard the learned counsel for the petitioners and learned HCGP for the respondent-State.
2. The petitioners have sought to quash the FIR in Crime No.213/2015 registered for the offences punishable under Sections 3 and 4 of the Karnataka Prohibition of Charging Exorbitant Interest Act, 2004 and Section 420 of IPC, 1860.
3. Learned counsel for the petitioners submits that petitioners are lawfully carrying on the business under valid licence and seeks time to produce the said licence in the matter which is now under investigation.
4. The petitioners are permitted to produce the said licence before the investigating officer. In such event, the investigating officer shall consider the said document and thereafter proceed with the matter in accordance with law.
5. With this observation, the petition is dismissed.
