Heard learned counsel for the applicant and learned A.G.A. for the State.
The instant anticipatory bail application has been filed with a prayer to grant anticipatory bail to the applicant, Dinesh Maurya, in Case Crime No. 0007 of 2021, under Section 306 IPC, Police Station- Badalpur, District- Jaunpur.
Despite time granted, no counter affidavit has been filed by learned A.G.A.
Learned A.G.A has filed counter affidavit which is taken on record.
The applicant has been implicated for offence under Section 306 IPC after one month of the incident. It has been submitted that it was an accidental death which has been turned into offence under Section 306 IPC. The police investigation is still under progress. The applicant has already on interim anticipatory bail as per order dated 04.02.2021.
Applicant will remain on anticipatory bail till cognizance is taken by the court on the police report u/s 173 (2) Cr.P.C. on same terms and conditions as mentioned in the order dated 04.02.2021.
The anticipatory bail application is allowed to the aforementioned extent.
