Heard Sri Pradeep Kumar Tiwari, Advocate, holding brief of Sri J.P. Yadav, learned counsel for the petitioner and learned Standing Counsel for the State respondent.
This writ petition has been filed seeking direction upon respondent no. 1 to conclude the mutation proceedings filed under Section 35 of U.P. Revenue Code, 2006 expeditiously.
From the instructions, so received, it appears that next date fixed in the matter is 25.10.2021. In view of the instructions, notice need not to be sent to the private respondents at this stage.
No useful purpose would be served in keeping the matter pending and, as such, writ petition is disposed of with a direction to respondent no. 1 to conclude the mutation proceedings by deciding the Case No. 395 of 2017 (Dinesh Kumar vs. Shakuntala and others), preferably on the next date fixed i.e. 25.10.2021 and, in case, the matter is adjourned, proceedings has to be concluded, in accordance with law, after affording opportunity of hearing to the parties concerned, preferably within a period of three months from the date of receipt of a copy of this order downloaded from the official website of the High Court.
Writ petition is disposed of.
