Heard learned counsel for the petitioner and the learned Standing Counsel.
Learned Standing Counsel has obtained instructions which for the purposes of identification are marked as 'X'. From the instruction provided it has come to light that the the petitioner is named as an accused in case crime No. 213 of 2015 in which he has been chargesheeted for various offences including under Sections 307, 323, 354, 452 and 506 IPC.The instructions further reveal that Non Bailable Warrants and processes under Section 82 Cr.P.C. have also been initiated against the petitioner on 02 July 2018.
Curiously there is no disclosure of these proceedings in the entire writ petition. Consequently the petition is dismissed for failure on the part of the petitioner to disclose material facts.
