Counsel for the petitioner is permitted to implead the Nagar Palika Parishad, respondent no. 11.
The petitioner filed a suit for partition under Section 116 of the U.P. Revenue Code, 2006.
In the suit vide order dated 22.02.2019, the property in suit has been ordered to be recorded in the name of the State. It is this order of the trial court which is impugned in this writ petition.
Against the order passed by the trial court in a suit under Section 116 of the Revenue Code, 2006, a first appeal lies to the Commissioner and a second appeal of the Board of Revenue.
These statutory alternative remedies have not been availed.
Under the circumstances, this writ petition is dismissed on the ground of availability of statutory alternative remedies which have not been availed.
