The petitioner seeks leave of the Court to withdraw the writ petition.
Shri M.C. Chaturvedi, learned Additional Advocate General assisted by Shri Satyendra Pratap Singh has raised an objection that the petitioner has filed a fresh writ petition and got an interim order from another Bench challenging the same order which he had filed in this writ petition by way of a supplementary affidavit and on the strength of that order, the instruction was sought by this Court.
Learned counsel for the petitioner submits that in the another writ petition, the petitioner has disclosed this fact.
Be that as it may, we are not satisfied with the conduct of the petitioner as once the said order was filed before this Court, he should not have filed another writ petition.
However, in view of the fact that the petitioner seeks leave of the Court to withdraw the writ petition, we grant leave to withdraw the writ petition subject to deposit of a sum of Rs. 5,000/- as a cost, which shall be deposited in the account of the State Legal Services Authority, High Court, Allahabad within a month from today.
A copy of this order be sent to the District Magistrate, Jalaun to recover the amount as arrears of land revenue if the petitioner fails to deposit the cost within one month.
