JUDGMENT / ORDER

Represented by their State Public Prosecutor, High Court Complex, Bengaluru – 560 001. …Respondent (By Sri.Chetan Desai, HCGP ) This Criminal Petition is filed under Section 439 of Cr.P.C, praying to enlarge the petitioner on bail in Crime No.47/2017 of Hulimavu Police Station, Bengaluru City for the offences P/U/S 353, 307, 332 and 504 read with 34 of IPC.
This petition coming on for Orders this day, the Court made the following:-
ORDER The petitioner - accused No.2 is in judicial custody in Crime No.47/2017 registered by the respondent-police. During the pendency of the petition, charge sheet is submitted to the Court in respect of the offences punishable under Sections 353, 332, 307, 504 read with 34 of IPC.
2. The allegation is, since petitioner was advised by the police personnel - complainant to drive the vehicle cautiously on the road, the accused picked up quarrel and assaulted them with wooden piece and kicked them.
3. Investigation having been complete, having regard to the nature of the allegation, there is no impediment to allow the petition.
Accordingly, the petition is allowed. Petitioner is enlarged on bail in Crime No.47/2017 of respondent- police, subject to the following conditions:
(i) He shall execute a self bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one local surety for the likesum to the satisfaction of the concerned court.
(ii) The surety and also the petitioner shall furnish the address proof to the Court and also to the I.O.
(iii) The surety shall submit the original title deeds of his property to the Court.
(iv) He shall attend the court regularly on all hearing dates.
