Heard Shri Akhilesh Kumar Yadav, learned counsel for the petitioner, learned standing counsel for the respondents no. 1 to 4 and Shri Manoj Kumar Yadav, learned counsel appearing for the respondent no. 5.
The petitioner in the writ petition is seeking a direction to the respondents to remove the illegal encroachment of the respondents no. 6 to 10 from the Gaon Sabha Land i.e. Nali Nalkoop (Gata No. 358 area 0.56 decimal/0.227 hectare) situated in village Gopalpur Pargana Barsathi Tehsil Madiyahun District Jaunpur. The relevant extract of revenue records have been filed as Annexure- 1 and 2 to the writ petition.
No useful purpose would be served in keeping this writ petition pending.
This writ petition is therefore disposed of with a direction to the respondent no. 4-Tehsildar Tehsil Madiyahun District Jaunpur to enquire into the matter and take appropriate action in accordance with law within a period of two months from the date of receipt of the certified copy of this order.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
