Heard Sri Anil Tiwari, learned counsel for the petitioner and learned Standing Counsel for respondents.
The petitioner in the writ petition is seeking quashing of the order dated 26.04.2017 whereby he has been placed under suspension as well as the order dated 28.03.2018 whereby a fresh enquiry has been ordered against the petitioner with additional charges which have been communicated to the petitioner through supplementary charge-sheet.
From a perusal of the record, we find that earlier the inquiry officer has submitted a report as would be clear from the order dated 28.03.2018 whereupon a fresh inquiry has been ordered with additional charges.
Without expressing any opinion on the merit of the case, we direct the inquiry officer to conclude the departmental proceedings against the petitioner positively within a period of three months from the date of receipt of the certified copy of this order in his office.
In case the inquiry is not completed within three months, the order of suspension shall stand revoked. Needless to say, the petitioner shall co-operate in the inquiry and the inquiry officer shall not grant any unnecessary adjournment to any of the parties.
With the aforesaid observations and directions, the writ petition is disposed of.
