Heard learned counsel for the applicant.
The applicant is before this Court against the wilful defiance of the order dated 5.2.2014 passed in Writ Petition No.303 of 2014 (Dr. Dinesh Kumar Srivastava v. District Judge & Ors.).
It is alleged by learned counsel for the applicant that the aforesaid order has wilfully been flouted as third party interest has been created in the matter.
The Court has proceeded to examine the record in question and find that proceeding under Section 52 of the Transfer of Property Act, 1982 is pending consideration before the court below. In case the applicant is aggrieved, he can file appropriate application under Order 39 Rule 2A CPC. Once alternative efficacious remedy is available to the applicant, there is no reason or occasion to proceed with the present contempt application.
In view of above, the contempt application stands disposed of.
Notices, if any, stand discharged.
