Following orders were passed in the matter on 23.07.2018:-
"Grievance is that petitioner's height was measured manually, both by the medical board and review medical board; while, at various other places, the height was examined electronically. It is also stated that petitioner has been given certificate by various doctors, including District Hospital, certifying that his height is 168 c.m., which was minimum height required for the purpose.
Learned standing counsel may obtain instructions in the matter. Put up this matter, in the additional cause list, on 31.07.2018"
Learned standing counsel has obtained instructions, according to which, petitioner's physical standards were measured in terms of the requirement in the Rules and his height was found below 168 c.m. Petitioner, then, submitted an appeal, which has also been considered and the height of the petitioner has been found to be 167.5 c.m.
Learned counsel for the petitioner submits that petitioner's height has been measured as 168 c.m. by the district hospital.
This Court finds that height of the petitioner has been measured twice and in both the reports, petitioner has been found deficient in the physical standard test. His height has been found as 167.5 c.m. by the medical board.
Such opinion of committee of various persons is not liable to be interfered with by this Court, particularly, as no perversity is, otherwise, shown. No allegation of mala fide is, otherwise, levelled.
The writ petition is, accordingly, dismissed. Copy of the instructions shall be furnished to the learned counsel for the petitioner.
