A preliminary objection has been raised by Sri Shivam Yadav, learned counsel appearing for the respondents that against the order impugned passed by the authority the petitioner has an alternative remedy under Section 28-A(4) of the U.P. Urban Planning and Development Act, 1973.
After hearing learned counsel for the parties, we are of the view that the petitioner has a statutory alternative remedy.
The writ petition is disposed of leaving it open to the petitioner to take recourse to the remedy available to him under law.
