1. Heard Sri Om Prakash Rai, learned counsel for petitioner and learned Standing Counsel as well as SriArvind Singh, Advocate for respondents.
2. This is a thoroughly misconceived and ill-advised writ petition. In a suit filed by petitioner, i.e., Original Suit No. 939 of 2001, Additional Civil Judge (Senior Division), Court No. 2, Ghaziabad vide order dated 25.08.2014 has granted a permanent injunction in respect of disputed property in favour of petitioner. If there is any grievance that said order has been violated, remedy lies before Court below but writ petition under Article 226 of the Constitution with similar relief that a mandamus be issued to respondents not to dispossess petitioner from disputed property, is not maintainable.
3. Dismissed accordingly.
