Sri Mohit Behari Mathur, counsel for the applicant, Sri Nand Kumar Shukla, Advocate, holding brief of Sri Pranjal Mehrotra, counsel for respondent no. 2 and Sri Faheem Ahmad, learned AGA for the State are present.
This is a petition under section 482 Cr.P.C. seeking quashing of the proceedings of Case No. 4334 of 2017 (State versus Dinesh Kumar @ Dinne and others) as well as charge-sheet no. 1 of 2017 dated 16.10.2017 issued against the applicant in Case crime no. 448 of 2017 under section 332, 353, 504, 427 IPC, Police Station Kotwali, District Rampur.
Learned counsel for the applicant Sri Mohit Behari Mathur seeks permission to withdraw the application with liberty to the applicant to seek appropriate remedy in accordance with law.
Sri Nand Kumar Shukla, Advocate, holding brief of Sri Pranjal Mehrotra, counsel for respondent no. 2 and Sri Faheem Ahmad, learned AGA for the State have no objection to the prayer made by counsel for the applicant.
Accordingly, the application under section 482 Cr.P.C. is dismissed as withdrawn with liberty to the applicant to seek appropriate remedy in accordance with law.
The certified copy of the impugned order be returned to counsel for the applicant, after retaining photocopy thereof, in accordance with rules.
