This petition under Articles-226 and 227 of the Constitution of India, has been preferred with the following prayers :
(a) YOUR LORDSHIPS BE PLEASED to admit this petition;
(b) YOUR LORDSHIPS BE PLEASED to allow this petition by way of issuing an appropriate writ, order or direction directing the Hon ble Family Court, Ahmedabad to decide and dispose off the Special Marriage Petition No.862/2007 most expeditiously or within any reasonable time as may be deemed fit by this Hon ble Court.
To pass any other appropriate and just order/s;
At the outset, Mr.P.M.Lakhani, learned advocate for the petitioner submits that the petitioner would make an application before the Family Court, Ahmedabad, to expedite the hearing of Special Marriage Petition No.862/2007 that has been filed by the petitioner and this Court may direct the Family Court to consider the same.
Upon the above statement made by learned counsel for the petitioner, the following order is passed :
In the event that the petitioner files an application for early hearing and decision of Special Marriage Petition No.862/2007, the Family Court, Ahmedabad, may consider and decide the same, in accordance with law, keeping in mind the reasons advanced by the petitioner therein.
The petition is disposed of, in the above terms, without entering into the merits of the case.
Direct service of this order is permitted.
