Heard learned counsel for the applicants and learned A.G.A. appearing for State and perused the record.
This application under Section 482 Cr.P.C. has been filed with the prayer to quash entire proceeding against the applicants in Complainant Case No.266 of 2018 (Virma Devi Versus Awatar Singh and others), P. S.-Shahganj, District-Agra, pending in the court of Additional Chief Judicial Magistrate, Court No.4, Agra and also quash order dated 12.02.2021 passed by Additional Session Judge, Court No.6, Agra in Criminal Revision No.140 of 2018 (Smt. Virma Devi Versus State of U.P. and others).
The impugned order dated 12.02.2021 clearly indicates that the matter has been remanded back to the court of Magistrate for decision afresh regarding summoning order. There is nothing adverse against the applicant in the impugned order nor present applicant has been summoned by learned Magistrate till date.
Under the circumstances, the present application is premature and it is, accordingly, disposed of.
